Terms & Conditions

Terms for the design competition "Start-up Design Award" run by the University of Bayreuth, Institute for Entrepreneurship and Innovation.

Scope

These terms apply to the "Start-up Design Award" established by the Institute for Entrepreneurship and Innovation at the University of Bayreuth (hereinafter "IEI") and the related activities and events. Any counter-confirmations by participants referring to their own (business) terms are expressly rejected. Deviations from these terms are only effective if expressly and explicitly confirmed in writing by the IEI.

Eligibility to participate

Participation in the "Start-up Design Award" is open to all companies. Products submitted for entry must not have been on the market for longer than 5 years. The IEI reserves the right to further define the eligible group of participants or competition entries. Employees and students of the University of Bayreuth are eligible to participate; this does not apply to IEI employees, who are excluded from participation.

1. Registration and formation of contract

Registration to submit an entry can only be made online via the following link www.startupdesignaward.com/bewerbung during the period from 6 March 2023 to 20 May 2023. Only one entry is permitted per participant. Confirmation of participation is sent by email. This forms a contract between the participant and the IEI. After registering, the participant receives a link by email to enter the required project information. All IEI staff members as well as the jury members are given access to the entries and the information from the registration.

2. Costs

The IEI does not charge any participation fees for the "Start-up Design Award".

Travel costs as well as costs for producing and submitting the entry are borne by the participant.

3. Submitting entries

When submitting their entries, participants are asked not to disclose any trade secrets or confidential information. They agree to the public recognition of their entry as well as to subsequent reporting about their entries.

4. Selection process/jury

In a non-public selection process, entries are evaluated by a jury selected by the IEI, which determines the winners. The jury also includes people who do not work at the University of Bayreuth. The selection process is confidential.

The evaluation criteria are set by the IEI on the competition homepage www.startupdesignaward.com. The jury awards the Start-up Design Award to the entries that best meet the evaluation criteria. The jury is not required to give reasons for its decisions.

5. Liability for entries

All participants confirm that they are the originators of the designs and of any intellectual property rights concerning their entry.

6. Rights of use and communication

All participants grant the IEI and the University of Bayreuth a free, and temporally, geographically, and substantively unrestricted right to use their submitted entry for all forms of use. The IEI and the University of Bayreuth are not obligated to name the creators of the submitted entries. Should creators nevertheless assert claims against the University of Bayreuth or the IEI, the winners shall indemnify the University of Bayreuth and the IEI against such claims.

Beyond the information required for the registration process, participants shall not submit any confidential or personal data.

Participation and any award may be contingent on participants approving the use of image material, spoken contributions, film material, and information about their entries as necessary to carry out the event.

In particular, participants permit the IEI and the University of Bayreuth the following uses:

– Online, across all communication channels of the University of Bayreuth and the IEI and, where applicable, associated media such as regional newspapers or start-up newsletters

– At the award ceremony, during a public event including film recordings (possibly livestreamed), audience, and photos

All nominated finalists and winners will be publicly named during the event. Winners are thereafter entitled to use the award granted to them in connection with their entry for their own purposes.

Use of the IEI's or the University of Bayreuth's logo is only permitted with the explicit prior consent of the IEI or the University of Bayreuth.

7. Reservation of rights

The IEI and the University of Bayreuth are entitled at any time to fully or partially forgo, or to postpone, the entire award and/or the award ceremony if urgent reasons (e.g., force majeure) require it. In the event of cancellation, the obligations of both contracting parties also lapse. Claims for damages or reimbursement of costs are not possible in the event of cancellation.

These terms and conditions remain valid for shortened or postponed event periods, provided that participants do not object in writing within 2 weeks.

8. Withdrawal by the participant / right of revocation

Within a period of 14 days after registration, the participant may revoke their registration in writing (e.g., by letter or email) without giving reasons.

9. Limitation of liability

The IEI and the University of Bayreuth expressly assume no liability or warranty if submitted or awarded entries infringe the rights of third parties. Claims for damages by participants, unless otherwise regulated in these terms, are excluded. This does not apply to liability in the following cases: intent, gross negligence of University or IEI staff or their legal representatives or executive employees under product liability law, fraud, culpable injury to life, body, or health, or culpable breach of material contractual obligations. In the latter case, the claim for damages is limited to the foreseeable damage typical for this type of contract, unless one of the aforementioned cases of liability applies. This does not shift the burden of proof to the disadvantage of the participant.

10. Competition claims

Entries that infringe third-party rights in any way (e.g., plagiarism) may be excluded from the competition at any time and participation may be terminated. Awards may also be revoked retroactively in such cases.

11. Final provisions

The place of jurisdiction is Bayreuth. German law exclusively applies.

Any agreements deviating from these terms require written form.

Should individual provisions of the foregoing terms be or become invalid, the validity of the remaining terms shall not be affected.
